I have really have no problems with the setting. I mean, isn't it weird if an RPG is set in contemporary times?
Of course, magic plays a big part of RPGs, but you don't necessarily have to be a wizard as there are a lot of classes to choose from... Of course, if you don't like the idea of points for your stats or levelling up, what are you doing with an RPG, anyway?
And finally, have you actually played any Elder Scrolls? The sheer depth of the gameplay and the amount of things you can do (you can have a profession, buy property and ships, sell weapons from dead enemies) makes it pretty awesome.
This coupled with the unique first person perspective and tres interesting puzzle-filled and strategic dungeon crawls (which is what sets it apart from other RPG with mundane dungeon crawls) makes Elder Scrolls a worthy 9 out of 10 in my book.
