Posted by Jim Lowry That is great news for those disabled boaters often overlooked or little cared about. The Marathon City Marina is not compliant with the Americans with Disabilities Act. The Americans with Disabilities Act states that Access to civic life by people with disabilities is a fundamental goal of the Americans with Disabilities Act (ADA). To ensure that this goal is met, Title II of the ADA requires State and local governments to make their programs and services accessible to persons with disabilities. This requirement extends not only to physical access at government facilities, programs, and events -- but also to policy changes that governmental entities must make to ensure that all people with disabilities can take part in, and benefit from, the programs and services of State and local governments. In addition, governmental entities must ensure effective communication -- including the provision of necessary auxiliary aids and services -- so that individuals with disabilities can participate in civic life. The ADA (Americans with Disabilities Act) defines a Boat Slip as; That portion of a pier, main pier, finger pier, or float where a boat is moored for the purpose of berthing, embarking, or disembarking. The Dinghy Dock float is where boats are moored for the purpose of berthing, embarking, or disembarking and as such, each Dinghy access is considered a Boat Slip. Under the ADA, a Mooring Ball is a float where boats are moored for the purpose of berthing, embarking, or disembarking and as such, each Mooring Ball is considered a Boat Slip. You see the Marathon City Marina does not supply the minimum number of accessible boat slips for the disabled as shown in: http://www.access-board.gov/recreation/final.htm And the city does not want to fight with the DOJ http://www.usdoj.gov/crt/ada/miamiflsa.htm The City of Marathon is taking the lead in the Keys and will be a model for others. Great steps are being taken by the Marathon City Marina, because they are hiring an ADA Consultant to bring the city marina into code.
as other cities have in the past. A fight with the DOJ only cost 4 times the money and is seldom ever won.
