City Unfairly Chargeing the Disabled at City Marina
On November 13, 2007 the City of Marathon passed Resolution 2007-164
This resolution approved the fees and rates for the use of the Boot Key Harbor City Marina facilities under Exhibit A.
And it directs staff not to charge dinghy dockage to the disabled until such time as the City Marina has achieved ADA Compliance.
According to Exhibit A;
Dinghy Dockage for vessels at anchor is a monthly rate of $120.00.
This fee is “all inclusive” of PumpOut, Showers, and parking for one (1) vehicle, right?
So if a person had two (2) vehicles, they would be required to pay $37.00 for the second vehicle for the month, correct?
If PumpOut, Showers, and Parking one (1) vehicle is “ALL Inclusive” in paying the Dinghy Dockage fee, and Resolution 2007-164 states the staff shall not charge dinghy dockage to the disabled until such time as the City Marina has achieved ADA Compliance, how can the City Marina now try to charge the disabled for the parking of one (vehicle) and for PumpOut?
If the Dinghy Dockage fee is “all inclusive” of PumpOut, Showers, and parking for one (1) vehicle, the City can not force the disabled to pay for those services for which non-disabled customers are not paying as the services are as stated “ALL Inclusive” in paying the Dinghy Dockage fee.
Yet, it has been brought to our attention, that is exactly what the City Marina is now doing. This needs to stop, and for those who have been forced to pay, that money needs to be refunded.
The City Marina needs to stop discriminating against the Disabled and Handicapped.
