Boot Key Harbor was saved, not by people like you, Howard, but by people who cared about the Harbor and the liveaboards who live here.
People like Pat and Dee, J.C and Paris, Ron and Lisa, Broke Neck John, Odie and Judy, Taxi Jim, Vince, Janet and Charlie, Nurse Rick, Carl and Marge , Bartender John, Tom, Lee, Butch and Martha, Dan and Debbie, and many many more.
It is the Howard Hubbard’s that offer no solutions, only rhetoric.
The people above fought to save this harbor using “the law” to make it what it is today. To save this harbor from developers. To enable the liveaboards to remain.
They used “the law”, while getting the city council to vote 4 to 1 to have the 6 onth “rule” removed from part of the bay bottom lease so the liveaboards could remain in Boot Key Harbor.
But sadly today, we have people like you, Howard Hubbard, who not only show they don’t care about people in the harbor, but show their ignorance of the law.
For people like that, I feel sad.
The idea is to help everyone as much as you can. The handicapped and disabled (really disabled) do not want anything more than equal access.
The ADA defines a Boat Slip as that portion of a pier, main pier, finger pier, or float where a boat is moored for the purpose of berthing, embarking, or disembarking.
Where a boat (no size listed, could be 4, 6, 12 or 40 ft) is moored (Howard you do know the meaning of moored, right?) for the purpose of… embarking and disembarking.
Now according to the ADA’s definition, that would and does include dinghies.
Now Howard, they say you were or are some type of Lawyer. If so, I sure hope it is only doing wills. And even then I might be afraid, due to your knowledge base.
You see, as you should know, WORDs in law, mean everything.
If I were you, before I talked about something I was not an expert in, I would become one.
I did. So can you, if you study hard enough.
Start by studing the post "Howard Howard Howard". There you will find the links to help you. Then after all that, go back and study everything at ADA.gov and the USSC ruling in Tenn. v Lane.
Howard, please be like the ones before you, and be part of the solution where people care.
Don’t be part of the problem.
