Answer: The Speaker of the House is second in the presidential line of succession, immediately following the Vice President as designated by the Presidential Succession Act of 1947. However, with the removal of Speaker Kevin McCarthy yesterday, that position currently stands vacant. Although Rep. Patrick McHenry was named acting speaker pro tempore, it is important to note that he does not have a claim to the presidency should it arise. According to the Presidential Succession Act, the president pro tempore of the Senate, currently Patty Murray, would assume the presidency until a new Speaker is elected.
Below is the current line of succession for the president of the United States:
No. Office Incumbent Party
1 Vice President Kamala Harris Democrat
2 Speaker of the House of Representatives Vacant Republican
3 President pro tempore of the Senate Patty Murray Democrat
4 Secretary of State Antony Blinken Democrat
5 Secretary of the Treasury Janet Yellen Democrat
6 Secretary of Defense Lloyd Austin Unknown
7 Attorney General Merrick Garland Democrat
8 Secretary of the Interior Deb Haaland Democrat
9 Secretary of Agriculture Tom Vilsack Democrat
