regarding the charter, yes, you are right, the State of New York (Supreme Court) did rule in favor of the EP (hierarchical vs. congregational). The point however is that whenever things go to court, THAT is the scandal.
As far as observing the "proper ecclesiology," this most certainly did not happen as metropolitans are archbishops who have suffragan bishops as electors. I see your point about making them "not auxiliaries" but that doesn't have to be done by elevating to the now-meaningless term "metropolitan." That can be done by just making them ordinaries. An ordinary can be any rank of bishop, including metropolitan and archbishop (and patriarch for that matter). After all, the title "patriarch" is an honorific. All patriarchs are first and foremost (arch)bishops of a specific city.
