I wouldn't be so quick to condemn the Synod. Four of the nine current members were consecrated following +Jonah's "election" as Metropolitan by the laity and clergy at the Nov 2008 All American Council.
The pattern for the last two years or so has been that the Synod would admonish +Jonah, +Jonah would agree to behave, then do as he saw fit. I'm sure there was significant consternation on the part of his brother bishops and the Metropolitan Council.
I am willing to bet that cheering +Jonah on was a fair sized group of people in one of the dioceses currently without a bishop, and that just complicated the matter.
However, unlike the financial scandal, this time the Synod did not try to pretend all was OK, took "progressive discipline", and when that did not change +Jonah's behavior, acted decisively.
So, "election" by clergy and laity may not be foolproof afterall. (Couldn't resist)
