I have lived here since December 2003. Since shortly after our move to this condo our upstairs neighbor has complained about my familys noise level, including TV, music, voice level and recently my morning alarm clock. His tactics for complaining have ranged from repeatedly pounding at my door, which not only invades my privacy but has also causes my wife concern and is boarding on harassment. In addition to his harassing behavior, he constantly stomps on the floors and pounds on the walls in the morning and evening like an insane monkey.
I am asking that the Casablanca Homeowners Association explain to this resident that he lives in a Condo and has to accept that he has neighbors that have a right to conduct their lives without harassment or invasion.
I have re-reviewed the Casablanca rules and have made notes below for your reference.
NOISE CONTROL
Noise can be a problem any time and particularly during the summer months when windows and sliding doors are open. Be considerate of others and remember that your neighbors may not keep the same hours you do.
C-1. Nothing shall be done that interferes with the quiet enjoyment of other residents. Neighbor pounding on walls and stomping on floors.
C-2 Be considerate of those living in close proximity to you and keep the noise volume as low as possible. We have moved our stereo speakers at the neighbors request, we also keep our stereo and TV as low as possible for our family to be able to hear and enjoy. Being constantly worried about pissing off the neighbor does not make life enjoyable.
C-3 It is the responsibility of parents and/or guardians to see that their children do not unnecessarily disturb other residents. Our children mostly play outside and are well-mannered.
C-4 Stereos, televisions, musical instruments, car alarms, party activities and any other noise sources (including barking dogs, car horns and loud radios and extending warming-up of motor vehicle engines) shall be restricted at all times to a level that does not disturb other residents and which cannot be heard outside of the residential unit. Again, we have a right to live and we keep our noise sources to an appropriate level. Lately, the neighbor has been pounding and stomping at the first sound of my alarm clock in the morning. Unfortunately we all cant be on his schedule and in order to wake up need an alarm in the morning to do so.
C-5 It is the responsibility of all owners and residents to inform their guests of the above noise control rules.
C-6 Abusive behavior including, but not limited to, the use of profanity on the part of residents toward Casablanca employees, contractors, etc., is not appropriate and will not be tolerated.
Upon notification of such behavior, the Property Manager is authorized to investigate each incident or incidents, which may include, but is not necessarily limited to, a verbal warning, written reprimand, temporary suspension from the use of association facility(ies) for a period or time or exclusion from the use of all association facilities.
