Yep, it's never been legal to drive an unroadworthy vehicle on the road, however, under the old system, before computerisation, there was no easily accessible way of finding out that your vehicle had failed an MOT, so you could still present your old bit of paper and as far as anyone was concerned, you still had a 'valid' MOT.
I'm amazed this is even a talking point, the computerised system has been in place for several years now - do people really not understand how it works ?
