First of all, the issue of the legality of ROMs pretty much is resolved: whether you like it or not, by the letter of the law, they are illegal. This is true regardless of whether you feel it is against the spirit of the law as well. The /. set attempts to obfuscate this fact as much as possible, but that does not change it. I say this as someone with a prodigious ROM collection, too.
Regarding the rest of this post: Welcome to every firmware or hardware upgrade on a gaming console ever. Each successive model of the PS2 was modified such that old mod chips wouldn't work on it. Each upgrade of the PSP and Wii firmware has broken old tools used to install custom firmware.
The reason for this is simple: while I'm sure there's a small core of 'ethical pirates' who are using these devices only with firmware or to test games and then dutifully delete or buy them after a week, these people are in the vast minority. 99 out of every 100 people with an Acekard are using it for one reason, and one reason only: To steal shit from Nintendo.
"Non-paying customers", which I believe is the current euphemism for pirates, directly hurt Nintendo's bottom line. Nintendo has no obligation to make life easy for them.
I had a lot more sympathy for "ethical pirates" before pirates destroyed the launch of Demigod and before it came out that indie game And Yet It Moves had a 95% piracy rate.
