Well, I dunno. I never thought it was that high a percentage. I'm involved with homebrew communities that are quite large, and I think you are over-estimating the pirate percentage.
Even so...geez, ya think Nintendo could learn something from this...people DO want the ability to download and store multiple games on one convenient cart. Why not take a lesson from Apple...and from the companies that rose from Napster's ashes?
RELEASE THE GODDAM TITLES INTO THE DSIWARE STORE. ALL CURRENT AND PREVIOUSLY RELEASED DS TITLES, AND GBA TITLES.
There are loads of us, I think, out here who would GLADLY pay...at the DSiWare Shop...for the type of convenience I am looking for.
We want what we want, and if Nintendo isn't gonna provide it for sale, then most of us will find a way to get it anyway. They might as well make some money off it.
I know I'd rather do what I'm doing in a 100 percent legal manner. Yes, I know ROMs are illegal...and there's lots of ethical questions, and I believe that, while it may be illegal...the way in which I use ROMs is entirely ethical.
I have no problem paying for what I get...but, and here's the rub...I also want to GET WHAT I PAID FOR. I did NOT pay for a device that the original manufacturer had the right to go in and "update" at any time of their choosing...in a manner that would alter the original functioning.
Had I known Nintendo was going to do that...and attempt to maintain the right to do it...I never would have bought a DSi.
Now that I DO know...I'll never buy another DSi or future game console ever again. I bought 2 more brand-new DS Lites. I now have my working one, and three brand new ones on the shelf, ready to take over if the old one breaks...all still in their original packaging.
I figure that should be enough to see to it I have at least one working model of it for the rest of my life, and a model that Nintendo can't go in and screw with.
Nintendo can kiss my gluteus maximus.

: First of all, the issue of the legality of
: ROMs pretty much is resolved: whether you
: like it or not, by the letter of the law,
: they are illegal. This is true regardless of
: whether you feel it is against the spirit of
: the law as well. The /. set attempts to
: obfuscate this fact as much as possible, but
: that does not change it. I say this as
: someone with a prodigious ROM collection,
: too.

: Regarding the rest of this post: Welcome to
: every firmware or hardware upgrade on a
: gaming console ever. Each successive model
: of the PS2 was modified such that old mod
: chips wouldn't work on it. Each upgrade of
: the PSP and Wii firmware has broken old
: tools used to install custom firmware.
:
: The reason for this is simple: while I'm
: sure there's a small core of 'ethical
: pirates' who are using these devices only
: with firmware or to test games and then
: dutifully delete or buy them after a week,
: these people are in the vast minority . 99
: out of every 100 people with an Acekard are
: using it for one reason, and one reason
: only: To steal shit from Nintendo.
:
: "Non-paying customers", which I
: believe is the current euphemism for
: pirates, directly hurt Nintendo's bottom
: line. Nintendo has no obligation to make
: life easy for them.
:
: I had a lot more sympathy for "ethical
: pirates" before pirates destroyed the
: launch of Demigod and before it came out
: that indie game And Yet It Moves had a 95%
: piracy rate.
