Clarification...

It is the AP that is relying on scare-tactics. They have no legal grounds to challenge on the basis of videos they have uploaded to Youtube - this doesn't even fall under "fair use," they agreed to the Terms of Service like every other user on there. As long as bloggers who imbed video are also doing so within the Terms of Service, they have nothing to fear - except, perhaps, that in the future the AP will refrain from posting videos on Youtube.
