If you want to wait around until after the trial, he might snap back to reality. If you decide not to wait, I wouldn't think you were out of line if you decide to date someone else. He isn't communicating with you like he should, and he's obviously not interested right now.
If it were me, and I was loooking at jail time, I'd be a little distracted too. Maybe it's a phase, and he'll snap out of it if he gets off. Maybe he's reevaluating his life, and needs some time to figure it all out before he can give you an answer. Maybe he is depressed. One of the key symptoms of depression is lack of interest or pleasure in previously enjoyable activities, that lasts for at least six months all day nearly everyday.
