Posted by Bern That was another persons question and my reply. Bern I am currently fighting VA disability and winning. I contracted Hepatitis C in the Marine Corp 26 years ago (age 19) I have been service connected as at the time they thought I had Hepatitis A yet tested negative for antibodies for A and posititve for antibodies for C as of late. I will be happy to e-mail you a copy of my claim and supporting evidence by fax. Hepatitis C is thought to be only a disease of the liver. This is wrong. The Hepatitis C virus has been proven to attack the bodies central nervous system and to cause symptoms that are 100% disabling. You need good evidence of fatigue, anxiety or other symptoms such as night sweats, ED, irritability, headaches etc. Hepatitis C is an organic disease. If you wake up feeling fine and with hours you start feeling tired than that is not mental illness but organic disease. If your ALT levels are higer than your AST levels that any liver damage is caused by Hepatitis C and not drinking. Doctors will try to look at you as a drug adict, problem drinker or mental patient in order to not admit that your symptoms are compensable. Thus actually causes anxiety and other problems such as depression. I have started a new claim for anxiety secondary to Hepatitis C and have doctors verification.I was rated 10% service connected as it was stated that I only experienced debilitating fatigue one to two eeeks out of the year ( a fabricted lie not in any medical records of mine), did not have any need for special drugs (there are none), was not under a doctors treatment for only Hepatitis C (and not the symptoms for which I was under treatment) and did not have any incapicitating episodes (fatigur that is daily and can only be treated by rest is debilitating). Well I have fatigue every day and it is stated in my medical records! There are no special drugs for Hepatitis C only treatment drugs such as interfuron and combination treatment once you qualify. The problem is that the VA, which is ahead of social security in the disability due to symptoms area still does not want to pay. Paying will open up the flood gates for paying other people like you. I have spent 3 years fighting and will win this appeal. They know that if they do not grant this 100% disability to me that I will go to the Board of Appeals for Veterans and eventually file a class action suit as the lead in a civil rights violation law suit against the VA. I will win, count on it. I am following their own rules and guidelines and have met them all.My doctor has stated that the only treatment for me is to live a health lifestyle, do not drink, and to live within the parameters that the disease allows me. These incude resting if you tired. Symptoms alone must be well documented and are eligible for 100% disability if you can prove to your doctors that your symptoms are debilitating in themselves. You must also have your doctor educate the deciding figure who rules on you disability claim as they know nothing. They think that no terminal liver diseasee than no disability. Bull. My liver only has minor damage (portal fibrosis on a scale of 1) on a scale of 1 to 4, with 4 being cirohis of the liver. The bottom line is email me at Berninfl@ yahoo.com and I will email you my claim with the whole story in microsoft word format. I will need a fax # also and I will fax you supporting documents I have compiled from reputable sources. NO CHARGE-JUST HELP. NOBODY HEPED ME AND I WOULD NOT QUIT. I spent hundreds of hours compiling the most up to date information on Hepatitis C and shoved it in their faces.I am told that the VA has no choice but to rate me 100% disabled because their first claim accepance of only 10% service connected disability is filed with holes (as I explained above)and I was recently DENIED work rehabilitation programs through the VA that would have compensated me but I had to work 30 hours a week to proved to the VA that I could work. My doctors would not allow it and hence the revocational training turn down. The VA can not turn me down for 100% disability because part time work (20-30 hours per week, is considered part time work ability and is still 100% compensible)is still considered disabled and how does it look to a Federal Judge (my next stop if denied) that the VA will not qualify me for revocational training benefits due to chronic fatigue and still say that I am not 100% disabled. They can't and I will win. There is not much precident for this and I will put you on an email list if you contact me so that you can use my precident in case law WHEN I win (Not if). Pray that I don't die from anything before my case is won as my case will open up the floodgates for people like you. It seems everyone is lost (including most doctors)and no one wants to help. Bullshit. Us Marines fight to the death and I put the same viogur in this disability case as I did being a Marine. It is combat!I will open the flood gates. The cost is going to be tremendous to the SS system and to the VA. They have no choice as Canada has already opened the flood gates for disability due to Hepatits C. This subject is a ticking time bomb and it is going off in my case and several others like mine in other parts of the US.
