Money doesn't have anything to do with legal "duty of care". DCC legal duty is the roads DCC are responsible for are safe to drive on. Period. End of.
If another company with services under a road has made said road unsafe, DCC legal duty is to make the road safe again. As DCC is likely not qualified to fix services under the road, DCC either requires the services owner to fix the fault and the road or appoints another qualified contractor to fix the fault and the road (then charges/sues the services owner for the cost of fixing the fault and the road).
That's how contract law works. Nothing complicated, just requires the DCC legal department to "grow a pair".
As I say, "Council letter says no responsibility", cobblers. You now know DCC are bullshitting. You personally might not be able directly to make DCC legal department to "grow a pair" but, as I say, in addition to moaning on here (where no-one can make DCC legal department "grow a pair", first speaking to the Local Government Ombudsman will find out whether an official complaint to the LGO will make the DCC legal department stop bullshitting, "grow a pair".
