LEGAL QUESTION
Posted by ERIC KENTON WARE on September 11, 2006, 5:39 pm It's a mitsubishi gto which came in with an intermittant missfire. Three days later customer back on phone - same fault - want money back. Now to the crux of the matter. Whilst testing it during this extra week - the engine developed a major big end knock. I now can no longer test for missfire to cure original complaint. Any advise would be gratfully received Kenton Ware

I'd tell them the knock needs fixing first or bite the bullet and give em there 300 quid back. All the best, it ain't gonna be easy !! Dave

Posted by Steve Nicholas on September 11, 2006, 6:06 pm, in reply to "LEGAL QUESTION" It sounds like a bit of a minefield to me and unless you have legal backing available through a professional body, then a solicitor's first consultation will probably exceed the cost of the secondhand engine. I have reasonable customers, who would accept that the big end failure is unrelated to the work done in this case and it would probably have happened to them anyway. In any case, they owe you for a new alternator etc. Negotiate on the rest. Good Luck. Regards, Steve

Posted by Rob Drinkwater on September 27, 2006, 11:57 pm, in reply to "Re: LEGAL QUESTION" Could even be that the length of time this customer of yours has had the misfire CAUSED the big end knock, let's face it, if the engine is now running so unevenly with the firing failure, the poor old crankshaft is getting bashed about far from smoothly & if the big ends were on the edge anyway, this misfire will have accelerated their demise.
