Speeding NIP #

Hi

Just a quick post ive just checked previous posts and wondered if there is any up to date info regarding speeding ticket in customers car and unable to identify the driver

The last posts were back in 2009
The offence happened when the customer dropped his car off for MOT and a service as we dont do MOTs ourselves I took the car to the station and the owner of the other garage dropped me back straight away in the same car as we are approx 1 mile away during this time a mobile camera unit caught one of us but the problem is we cant identify which one by the photos you can download .Neither of us remeber seeing the van but honestly dont know who it was .Any help or advise would be greatly received as im sure I wont be the only one this has happened to cheers Pete

Hi Peter,
Can't you tell from the background of the photo which direction the vehicle was driving, to or from the Mot station ?

If you google Pepipoo speeding, this is a very useful website that gives good advice on speeding, parking tickets etc etc

A colleague was in this position but in his own vehicle. He didn't deny the offence but couldn't tell whether it was him or his wife driving (was a van although he does moan like a woman).

He took legal advice and was advised to ask the police who they intend to prosecute as he couldn't be sure of the driver. The solicitor told him to let them take it to court. In the end they dropped the case before court and sent a stern warning.

I would ask who they intend to prosecute as you do not know and the evidence does not allow for identification. I don't know if its myth or fact but I thought something changed meaning that if a driver can't be determined the registered keeper was prosecuted.

Maybe try a solicitor that offers a free 30min consultation.

I know this is a bit old but have just gone through this in court.

My works van was caught speeding and by the time I got the NIP it was about 6 months old due to me not being the registered keeper.

I knew where I was on the day due to work log but that is it.

The van could be used by anyone in the depot I was at at the time but I never kept records of that.

They wrote to me stating I had to identify driver or go to court.

Pictures were rubbish so said I couldn't i.d.

Long story short........I went to court, they said how could I deny the charge of failing to provide driver details?

I gave them printouts of times I was on jobs, said I had asked everyone in the depot on the day and had shown photos to everyone.

They reluctantly dropped the charges.
