Still, if he was Harry Smith who worked in a bar and had somewhow done the same things I doubt he would have had such a long and fruiful engagement with the notoriously fair and just U.S. system /sarc.
The normal outcome in the vast majority of these appeals, at least when it's some Black geezer who can't afford benches full of lawyers, is, "Yes, this was a legal mistake BUT it wouldn't have altered the jury's verdict" so appeal denied. Read Clive Stafford Smith on how often this is trotted out or even better, "Barred: Why the Innocent Can't Get Out of Prison" by Daniel Medwed for a mind boggling look at how the odds are stacked against the defendant.
It's noticeable they haven't employed this standard here although I can't see him getting off at the retrial so it's probably going to be meaningless but you never know.
