He shot people dead in the first incident because that is basically allowable under US law: The precise details of whether he was really cornered in the first incident are probably open to interpretation, but since it takes a unanimous jury to convict, then the law was essentially on his side. The issue of whether he was there solely protecting property is also relevant when considering original motive.
