Hi Den, >I would suggest then that if the T's and C's were not presented in full, or referred to in the contract your Son signed, then this it what the Judge has referred to No, individual T&C cannot overrule statute law, in this case the provisions of the Consumer Rights Act 2015, doesn't matter whether T&C are "presented in full, or referred to in the contract" or not. T&C can also be ruled illegal by the Unfair Contract Terms Act if contractual wording could be used to give one party to a contract an unfair advantage over the other party/parties. Hth. Regards, |
