1968 BSA A65 Firebird scrambler. Total rebuild to top spec and a show winner. I don't think you will find a better one.

I missed a Firebird Scrmabler at Andy Tiernan's while he was on holiday doing the Irish National. He asked if I could wait until he got home, then never got back to me.

Trouble is, I don't want a show bike. I want something I can fettle and ride and not worry to much if it gets dirty.

It is nice jerry, just make sure he does not sell it to Russell james motorcycles. I have had more dealings with him Today and had to involve a police car arriving to tell him why he could not take the complete registration document with Steves name on it. Once explained that he could only have the trader tear off slip, his driver had to accept that.
I told the driver to remind Russell about what Judge Priddis told him in court January.
Sent a plain van with no name as his own van has no trading name either.
Be very wary of that name. I explained to his courier he is a con artist as detailed in Court

Steve and i stood up on the gallery watching him until he eyeballed us. Must have worried him what we were telling quite a few people nearby.
Next stage of the game is a review on a site he cannot edit then Triumph motorcycles can deal with him using their trademarks for early Triumph and Hinckley models. He has recently admitted on a review site his custom builds are for static display only as they are unroadworthy and will need repairs to make them useable on roads

That Firebird is worth 5.5k easily but at the moment, it appears there is a hole in the market and people are not buying as they age.
My offer of a Frank still applies though. Den might raise another Frank

I would think it was worth a bit more just 3 years ago but watching the market, he may get 6k for it. Not much money for that sort of quality is it. When you now see 250 Yamahas selling at over 6k, it makes no sense.

. Bring it here and i will convert it to a heel and toe change like my Spitfire and more cripples could buy it.

He is about mid 50s Andy and only 2 on that stand wearing matching Triumph jackets. That young one was told by the Judge that he did not seem to know much about motorcycles but he did say his job was to keep them clean.

I worked at a dealer selling those new,really hard to shift probably because of that ugliest and impractical exhaust system.
Even through rose tinted specs I can't see that attractive and as for £5.5, you having a laugh?

David, read his terms and conditions which state any bike he sells will almost certainly need repairs or maintenance as soon as the bike is bought from him. before you even ride it. This was brought out well by the Judge that he had conditions which break UK laws but in the advertising he states he complies with all laws.
Walter Mitty character and a clever salesman at telling lies. Very threatening if challenged and calls your bluff if threatened by legal action.
Taking suppliers to court does not discourage me at all and in every case i get swindled, they will face a Judge. That included the now defunct Lunn Poly holidays and Ford motor company who also paid out a lot more than they were thinking they would.
This Russell Insall calling himself Russell James should be out of business by now but suckers are out there like my Stepson who bought before telling me what he had done.

I bow to your experience Geoff, and the Judges, but I fail to see how he is breaking the law if his T's and C's clearly state that the bikes are not rideable or road worthy. This seems to be a case of "buyer beware" and it is the buyer's responsibility to seek out what is wrong and in need of repair before buying, and get that written down. If the seller cannot qualify that, or refuses, walk away. Maybe it wasn't this particular clause the Judge was referring too.

Den, he did not show or display the conditions of sale on the premises and the Judge, having been given a copy, ruled them illegal. The bike was stated to be ready to ride home fully prepared and needing nothing doing to it.
Most people seeing a gleaming display of bikes in a showroom would think it is genuine. Yesterday Evening when collecting the bike, police were called as he was breaching the peace and threats to Steve demanding more money and documents owned by Steve.
No trader can issue illegal terms and conditions so maybe he will carry on the deception or might have learned not to take on a defence at the County court. The defendant, Russell James Motorcycles was guilty of selling a faulty dangerous £6000 motorcycle stated to be in perfect condition and road tested over 1000 miles. The truth came out that the bike was tested on a 100 yard gravel path and over 2 years, it had moved just 1 mile. He now has a CCJ registered against his business which will make it more difficult for him to borrow.
He did pay back £7000 including costs after first refusing. We told him we would go back to Judge Priddis and begin the seizure of goods process plus costs then he paid in full. He was quite prepared to defy the court order.
His preparation of the bike did not include an oil change which might have resulted in the engine failure. Last record of new oil was 1987 although someone must have changed it when the engine was built in 2019 but again, all the engine build and details were not handed over with the history

I often wonder what price my BSA A65 Spitfire would sell for. Bought in 2009 for 2300 pounds and i did a light refresh to chrome,tyres,tubes .handlebars etc so spent about another 700 pounds to make it a really nice bike. Mine is not matching numbers so would be lower than the perfect bike. Not selling just yet but at the moment, i just dont see too many bikes being sold. At various bike meets, no one is coming along with a recent purchase. This is a bit like the pre-war cars that seem to be very cheap now although a 1970s Ford Escort can be up to 20,000 pounds

I would suggest then that if the T's and C's were not presented in full, or referred to in the contract your Son signed, then this it what the Judge has referred to as your Son cannot be bound to conditions he hasn't seen, or had his attention drawn to, and thus wouldn't have applied in his case. Whatever the reason was this chap seems a good one to avoid.

Den, Steve is dyslexic as well but the conditions were not offered or on show but i expect he might show them now. If someone did read these conditions, no one would buy a bike at all.
Steve only buys from dealers with his cars and bikes and never a private seller as he trusts the business knowing he has a comeback if it goes wrong. His other Triumph was from a Triumph main dealer and all his cars have come from used car dealerships.
No matter how many lies this bike dealer told the judge, she could tell he was telling lies when asking the same question after a couple of minutes and he had a different answer. These Judges are there because they are good at that job. What really ruined his case was shouting at the judge that she did not know the law and he stormed out returning after a few minutes.
Steve will not be buying any old bikes for quite awhile now but he may have my R111 that is now too heavy for me. Then i can still see it !

I agree, this guy seems like a total waste. Storming out of court would never be a good point in anybody's favour. Certainly a lesson for your Son to be learnt and good that he had you to help him through it all.

well, he seems to sell a lot of bikes, and ruined a good few of them. The longest terms and conditions I have ever read, and vaguely belligerent in my view.

Trials and scrambler seem to be more of a fashion label than suitability for use these days, not one of those high barred knobbly tyre bikes would be of any use what so ever of road, unless maybe the pub car park is muddy.

No, individual T&C cannot overrule statute law, in this case the provisions of the Consumer Rights Act 2015, doesn't matter whether T&C are "presented in full, or referred to in the contract" or not.

T&C can also be ruled illegal by the Unfair Contract Terms Act if contractual wording could be used to give one party to a contract an unfair advantage over the other party/parties.

Agree Stuart. But what they say or what they don't say, is totally irrelevant if they do not form part of a contract and were never presented, or signed up to, by the buyer, then they would have no relevance inside or outside a court of law. Either way this "gentleman" seems to have the makings of a class one rogue.

To be a successful rogue, one has to have some common about one.

Otoh, "this gentleman" just seems to be a class one clueless knob-end. If Geoff has the time and inclination to take up all the suggestions in his TriumphRat.Net thread, "this gentleman" will be dobbed to HMRC, Somerset County Council, Hinckley, all the classic bike rags publishers, editors and ad. managers ...

I put a comment on his youtube advert explaining what happened to the bike and his visit to the Judge.
He removed it the same day so i will comment on a few of the others. They are old adverts and the bikes have been sold on but its fun that his adverts are going missing this year.
