Den, he did not show or display the conditions of sale on the premises and the Judge, having been given a copy, ruled them illegal. The bike was stated to be ready to ride home fully prepared and needing nothing doing to it. Most people seeing a gleaming display of bikes in a showroom would think it is genuine. Yesterday Evening when collecting the bike, police were called as he was breaching the peace and threats to Steve demanding more money and documents owned by Steve. No trader can issue illegal terms and conditions so maybe he will carry on the deception or might have learned not to take on a defence at the County court. The defendant, Russell James Motorcycles was guilty of selling a faulty dangerous £6000 motorcycle stated to be in perfect condition and road tested over 1000 miles. The truth came out that the bike was tested on a 100 yard gravel path and over 2 years, it had moved just 1 mile. He now has a CCJ registered against his business which will make it more difficult for him to borrow. He did pay back £7000 including costs after first refusing. We told him we would go back to Judge Priddis and begin the seizure of goods process plus costs then he paid in full. He was quite prepared to defy the court order. His preparation of the bike did not include an oil change which might have resulted in the engine failure. Last record of new oil was 1987 although someone must have changed it when the engine was built in 2019 but again, all the engine build and details were not handed over with the history |
