Hi,

Obviously if the vehicle develops a fault such as a serious misfire, which subsequently goes unrepaired & destroys the catalyst,then it is not your responsibilty.
One observation I can make though, many aftermarket cats seem to fail the second MoT, not because of any underlying vehicle problem but because they are poor quality.
