There are TWO points to this, first is You still have a current test certificate, so you CANNOT be prosecuted for failing to have a current MOT. The second & more important issue is of course driving a un roadworthy vehicle, which of course you CAN be prosecuted for and will clearly have NO defense or mitigating circumstance to help you. As for insurance, I am no expert but my understanding is that they may well opt out of any claims from the insured, BUT will have to honor 3rd party claims.
