We need to remember that the MOT test, does not change the condition of the car. if it is unroadworthy after the test (serious fail ) , it was the same before. Therefore it was illegal to drive BEFORE the test, the fact that it now has a fail sheet make no difference. I have never seen an insurance policy that says you must not 'KNOWINGLY' use a unroadworthy vehicle, likewise with Police prosecutions, 'Ignorance is no excuse is my understanding' It is of course possible for a unroadworthy car to correctly pass the MOT test. have a look how many advise defects have a dangerous marker against them on the test computer !!!!
