This seems a very strange case to me. There must be thousands of couples (if not more) where, for example, one partner has dementia and cannot meaningfully consent to sex. Do social services intend to police all of these relationships? That they have taken these measures in this case suggests there is a lot more going on here than is in the public domain which may explain the judge's apparently bizarre remarks.
