This suggestion from blogging barrister Amanda Bancroft is that the judge was not meaning the right for a man to have sex with his wife was absolute - but rather a couple has a right to have sex within the context of a family life, which is a human right. It's a pity he said 'the man' if he meant 'the couple', if so it certainly left him liable to be misunderstood.
