I'm not sure, but I think that most insurers require you to report any accident, regardless of whose fault it may or may not be. I'd let your insurer sort it out. I suppose not reporting in the first instance and repairing the vehicle may have complicated things. In terms of suing, ask your solicitor whose name should be on the papers.
