Posted by Paul Howd on May 17, 2006, 9:59 am, in reply to "Re: total loss damged car while in for repair" Last year, I had a customer with an old ("Worthless" but good condition) metro who had an accedent shortly after an extensive service (including cambelt and water pump) He felt that the offer was low so he sent them a copy of my invoice and they significantly increased the offer. There are some good ones out there! Paul

The car owner is not going to pay & anyone suggesting that they should needs a reality check. The third party insurer is going to argue that they only cover the costs of the vehicle damage & not any repairs that are currently unsettled. Perhaps the customer could put in a claim for the loss of his/her car & you the "repairer" could put in a claim for the loss of revenue in a separate claim. The garages public liability cover is another way I think that you could peruse a claim. Although I don't think that the long-term effect of this would make it viable i.e. next years premium & any excess would negate any benefit of a claim. As I say, whilst its not the nicest of things to happen, the two things are seperate.. ie, job & insurance claim. The job is done - that part of the operation needs paying for. The accident has happened - that part of the operation will get paid for. I know he may not like it - its not nice but thats how it is. Why should you lose out??? Thats how I would approach it .. Hope this helps you Roy . Let us know how its going, As a little extra - but the scenario is similar if not very much the same and may help you -- So, I explained to customer that the head gasket's gone, engine started fine at first cos there was very little coolant in... till I topped/filled it up.. then things showed up. Now then... DO i give him his money back for what Ive done thus far --??? He's weighing up whether to have the job done or not. and may not.... Do I give him his money back - and lose out??? You have to rememeber, HE's not wanting to lose out - HEs wanting YOU to lose out... doesnt sound fair to me. Hth in weighing things up Roy - and anyone else..

Posted by Steve H on May 20, 2006, 6:08 am, in reply to "Re: total loss damged car while in for repair" The difference between this and the Mondeo described above is that the head gasket failed as a result of the fault on the car which the owner is liable for; not the same as having a fault fixed and then something else happen whilst the car is entirely out of his control. Seems to me that the answer is to include the £600 in the claim against the third party. He is liable for the damage that he has done so that will include an allowance for the condition of the car. The insurance company will try to go for basic trade value but they do have to take into account any other factors. The final amount is just down to the negotiation!

I am glad that it worked out fine for you & your customer. However it could be argued that, until the customer has received or accepted the vehicle back into his/her custody that the transaction is not complete. It is common for body shops to ask the customer to sign a satisfaction form at the time of collection. I understand that in the mechanical world this would be unworkable, but the point I am trying to make is that, it could be argued that the job may not have been completed satisfactorily & as such may not be eligible for a claim. Example: - You have a problem that has caused you to take your 53 plate Corsa back to the dealer for the third time. You are loosing confidence in there ability to sort your problem & you go to collect it. They inform you that “this time we definitely had fixed it” & “We had to replace the MAF sensor & it turned out the ECM was also faulty, so we replaced it also. Unfortunately the car was destroyed in a “””whatever””” Blahdy blah... We would be grateful if you would settle the bill. A more unscrupleless insurer may not be as forthcoming with payment. That coupled with a nuisance customer & it’s stormy waters ahead!!!

The car was worth £500 book value but it had a gas conversion on it. The conversion was a few years old and he didn't have reciepts for it but he argued that it would cost him £2k to fit a conversion to what ever car he got next and he had a right to do this as the car that got trashed was gas converted. He ended up walking away with £2k for a £500 car. It might be too late in this case but always hang in there with insurance companies - it's a game of poker and you have to make them flinch!
