My wife was driving my car the other day when someone crashed into the back.They stopped, gave their name, address and phone number and said they would pay for the damage.
That was fine I thought as I wasn't going to make any claim on my trade insurance for something that plainly wasn't our fault.
When the guy got the estimate, of course he complained it was too high and after sending him a couple of letters the repair went ahead anyway.
I now am going to sue him for the money.
The only question I need answering is:
Should my wife sue him as she was the driver?
Or should I sue him as I am the owner?
I might add that I am totally confident of success and have sucessfully used the small claims court at least a dozen times in the last 30 years.
My wife says that although she is happy to sue him (with my assistance) she would prefer if I did it.
Any thoughts please?
