If I go through a green light and hit a pedestrian in a car, I'm still at fault because I am not paying attention to hazards (unknowns on the road). If I followed the same logic I'd have killed hundreds of pedestrians by now. Anything moving at speed (and 20-30 mph inc cyclists), needs to behave as a potentially dangerous vehicle. Sure it takes effort to stop then start again. Better than wiping out pedestrians. I can see why legally both would be at fault, and why it might go from there to personal claims. It's not an odd response, just a uniformly fair one. Everyone on the road needs to act with more courtesy, regardless of whether they are motored, non motored or pedestrian. Presently, that's not happening. If this example encourages some sober thinking on the subject,,then great.
