After all, if done properly, the car was considered to be lawful at the time, as it should easily pass the annual emissions test as it is currently applied.
It is only now that we are told that the driver is contravening the law, by deliberately using a modified car. So the previous repair route, offered in good faith, is now deemed to be illegal! Who is the bad guy here? "

The removal of an emission device and modifying the software has not been legal from day one, nothing has changed, no new laws created
The government and VOSA officials that sit behind desks did not envisage or imagine that garages would remove and tamper with the DPF devices. It is only recently that Twitter campaigns by some such as Cleaner Air for London have brought this to their attention as Lorries, Vans, Taxis and Cars have had a DPF removed and causing excessive levels of pollution in London and other major cities
All that has happened is that VOSA is just bringing in an additional check to make sure they are still present
